ii. 業權︰ Share of Freehold 不是

Freehold ？比 Leasehold 有

更大自主權

業 權 種 類 除 了 主 要 的 兩 類， 即 是 Leasehold 和 Freehold 之 外， 還 有
Share of Freehold，比較常見於舊式或小部份新建小型單幢住宅物業。
名字上有點誤導令人以為較近似 Freehold，其實只是一種比較特別的
Leasehold，Share of Freehold 在土地註冊署 (Land Registry) 記錄中更是
列為 Leasehold。

和 Leasehold 不同的是，Freeholder 並不是第三方，而是一間由部份或全
部業主擁有股份的公司（也解釋了名字的由來），相關的股份通常會於
出售物業時同時轉讓予新業主。

Share of Freehold 比 Leasehold 稍為優勝之處在於業主有更大權利，可
以聯同其他業主，通過 Deed of Variation 更改地租租約或給予特別允許
(Consent)。這一點也相當重要，特別是 Leasehold 中常有不合理的地租
條款嚴重影響業主，但卻無能力反對，也沒有跟 Freeholder 商討的權利。
